AS-IS CONDITION: The Seller sells and the Buyer purchases the above-described all-terrain vehicle in its current AS-IS, WHERE-IS condition, with all faults. The Buyer has inspected the ATV or waived the right to inspect and accepts it in its present condition. No warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, are provided with this sale.
TITLE AND OWNERSHIP: The Seller warrants that they are the legal owner of the all-terrain vehicle, have full right and authority to sell it, and that the ATV is free from all liens, encumbrances, and claims of third parties. The Seller agrees to provide proper documentation to transfer title to the Buyer and will defend the Buyer’s ownership against any lawful claims.
RELEASE OF LIABILITY: Upon completion of this sale and transfer of possession, the Seller is released from all liability arising from the use, operation, or ownership of the all-terrain vehicle. The Buyer assumes all responsibility for registration, insurance, operation, and any damages, injuries, or violations that occur after the date of sale. The Buyer agrees to indemnify and hold the Seller harmless from any claims arising from the Buyer’s use of the ATV.
OFF-ROAD USE ACKNOWLEDGMENT: The Buyer acknowledges that this all-terrain vehicle is designed for off-road use and may not be street-legal in all jurisdictions. The Buyer is responsible for understanding and complying with all federal, state, provincial, and local laws regarding ATV registration, operation, safety equipment, age restrictions, and permissible use areas. The Buyer assumes all responsibility for ensuring lawful operation of the vehicle.
ENTIRE AGREEMENT: This Bill of Sale constitutes the entire agreement between the parties concerning the sale of the all-terrain vehicle and supersedes all prior negotiations, representations, and agreements. No modifications to this agreement shall be valid unless made in writing and signed by both parties. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
GOVERNING LAW: This Bill of Sale shall be governed by, construed, and enforced in accordance with the laws of the Province/State of .
